The Urban Development Department of San Miguel de Allende closed a house for rent offered by the Airbnb platform for lack of land use and omitting citations to carry out the procedures.
Francisco García, director of Historical and Heritage Center, explained that the intention of the closure is to regularize the land use of the property. It is the first closing of a house offered through the Airbnb platform.
He affirmed that the owners did not carry out the procedures, nor did they go to the subpoenas that were given the addresses of Urban Development and Historical and Heritage Center.
The purpose of this land use and that, of course, has a cost; is to help the services of the municipality that is required to give in addition to the existing ones. When these types of occupations are already beginning and more people arrive than can be found in hotels (which pay their taxes) and are full, they begin to generate a series of additional public services, he said.
He informed that of the 3,500-holiday rental houses that exist in the urban area, 500 are in the first square of the city. At least 100 have already begun their land-use procedures, and another 400 approached to start the process.
The director of the Historical and Heritage Center commented that the process that the owners have to carry out is simple, a format issued by the Urban Development Department is filled out and documents are presented:
- Simple copy of title.
- Simple copy of property payment.
- Simple copy of a letter of no inconvenience for the requested use issued by Civil Protection.
- Simple copy of water receipt.
- Localization map.
- Photographs of the property.
- Simple copy of a lease (if leased).
- Original letter of no inconvenience and approval of the owner of the requested use.
- Power of attorney of the person who carries out the procedure in case of not being the owner or the lessee
- INE copy of the owner.
- INE copy of the person processing.
- Copy of damage insurance to third parties.
The previous documents make up the folder that Urban Development will have to approve land use. Finally, to approve the license, 10,000 pesos will be paid annually, divided into two semi-annual payments of 5,000 pesos.
The government of San Miguel de Allende regulates the rental of real estate since January 1, 2019.
At the federal level, the Federation’s Expenditure Budget (PEF) discusses the possibility of collecting taxes from users of this service platform – and others such as Uber and Rappi – starting next year.
Locally, Panista deputy Miguel Salim prepares a Law to regulate digital platforms, after an explosion, last March claimed the lives of three students from the University of La Salle Bajío who had rented a house through Airbnb in Guanajuato capital.
Salim’s proposal is currently in consultation with the 46 municipalities and associations.
