In September 2020, the president of the United States, Donald Trump, lost ownership of his last registered trademark in Mexico, ‘The Donald J. Trump Signature’, so, if it was not renewed, he would lose his rights over it.

File 1122230 details that this trademark, registered with the Mexican Institute of Industrial Property (IMPI), granted the rights to that name for use in hotel services, motels, restaurants, bars, cafes, and in general, as well as for food and beverage services, and even clothing and footwear, reveals El Universal.

Trump a punto de perder sus marcas en México

The US president started his business in Mexico in 2005, when he registered up to 26 trademarks in his name. Since then, the records of none have been renewed at the end of their validity, reported Milenio.

The same media reported that most of the trademarks were under the legal power of María Teresa Eljure Téllez, an associate of the firm Arochi & Lindner, SC, a law firm that provides legal advice on intellectual property.

The firm managed the trademark registrations for the tycoon, without interfering with his operation. However, it processed registrations for businesses that were not carried out, such as ‘ Trump Isla Cozumel ‘,’ Trump Ocean Resort ‘,’ Trump Elegance ‘,’ Trump Home ‘,’ Trump Attaché ‘,’ The Spa at Trump ‘and’ Trump. ‘

‘Trump Isla Cozumel’ and ‘Trump Ocean Resort’ were part of a business plan raised during Felipe Calderón’s administration (2006-2012) that were not consolidated.

‘Trump Isla Cozumel’ was even presented as a plan with an initial budget of 10 million dollars. However, the Calderón administration declared three-quarters of the island of Cozumel as a protected natural area, which blocked the construction of this hotel.

Similarly, ‘Trump Ocean Resort’ was shaping up to be a hotel complex based in the state of Baja California. This project was announced in 2006 as a partnership between the Irongate construction company and the Trump Organization. The developers anticipated a payment of $ 500,000, for which its cancellation triggered a class-action lawsuit against the tycoon, as well as a legal battle that lasted five years.

Article 237 of the Federal Law for the Protection of Mexican Industrial Property establishes that the renewal of the registration of a trademark must be requested by the owner within six months prior to the expiration of its validity. However, it empowers the IMPI to process applications submitted within a period of up to six months after the expiration of the registration period.

“In case of not complying with the requirement within the indicated term, the registration will expire by right, without requiring a declaration by the institute”, explains the Law.

Other Trump family trademark registrations

The businessman’s daughter, Ivanka Trump, also has trademark registrations in Mexico with Ivanka Trump Marks LLC as the owner. However, some also expired this year and it is unknown if their renewal has already been requested, as they are still within the deadline. Its products are classified into clothing, footwear, accessories and headgear, among others.
