For presenting insufficient information and not having solved the requests to expand the content of the Environmental Impact Manifesto in its particular modality (MIA-P), the Ministry of Environment and Natural Resources (Semarnat) denied the Government of the State of Sinaloa the authorization of the project “Jacques-Ives Cousteau Square”.
The work may not start until it has the respective authorization in terms of environmental impact, so it is prohibited to carry out activities related to the project, as required in the resolution issued by Semarnat.
The promoter may file a review appeal, within 15 business days following the date of his denial of the suspension.
Background
The resolution issued by Semarnat indicates that on July 10, 2018, the deadline for the State Government to deliver the additional information requested on April 5, 2019, so that the General Directorate of Environmental Impact and Risk (DGIRA) ) He resolved the project, with the information he had.
On April 17, 2019, the DGIRA requested the technical opinion from the General Directorate of the Federal Maritime Terrestrial Zone and Coastal Zone, Secretariat of Sustainable Development of the Government of the State of Sinaloa and the City Council of Mazatlan.
As the DGIRA is responsible for analyzing, evaluating and solving the MIA-P of the project, it resolved with the existing information.
The project is about the construction, operation and maintenance of urban and tourist infrastructure, constituted by an esplanade (viewpoint), which will include stairways, ramps and bleachers, and that will serve as a venue for events, shows and rest and meditation space for the community of Mazatlan.
These works would affect a section of the federal maritime land area. The location contemplated for said infrastructure is Paseo Claussen, in the space currently occupied by the Telecom building.
Public consultation was missing
One of the first breaches of the State Government was to carry out a public consultation in accordance with the provisions of article 40 of the Regulations of the General Law of Ecological Balance and Environmental Protection in Environmental Impact Assessment (RLGEEPAMEIA).
The date expired on April 11 and requests for public consultation were not received.
Other inconsistencies
Based on the description of the project, the DGIRA identified several deficiencies in relation to the works that would be part of the project and that should be clarified, among which are: specify which will be the works and activities considered in the project, inform if explosives will be used for site adequacy; indicate the activities to be carried out to enable the maneuvering yard and submit the dimensional specifications (lengths, widths, diameters) of permanent works, such as courtyards, stairs, storm drains, electrical installations and green areas.
It is also requested that the area subject to the removal of vegetation is required due to the development of the project, the species to be dismantled and if they maintain any status according to NOM-059-SEMARNAT-2010.
In the same way inconsistencies were identified in the description of the environmental system and its problem in the area of influence.
Nor was the identification, description and evaluation of the environmental impacts that the project could potentially cause, and the proposed preventive and mitigation measures added.
Once the MIA-P was evaluated, the Secretariat issued the resolution denying the authorization.
