Mazatlán, Sin.- Given the new anti-tobacco Law that began to be applied in Mexico as of January 15, which prohibits smoking in public spaces, its regulations includes high economic and even corporal sanctions, the National Chamber of the Restaurant Industry and Seasoned Foods in Mazatlán began to socialize the issue with the members and is already contemplating an upcoming meeting with personnel from the State Commission for the Protection against Sanitary Risks of Sinaloa (Coepriss), in order to clear up doubts .

The president of Canirac Mazatlán, Rodrigo Becerra Rodríguez, indicated that the situation is perceived as difficult because everything indicates that they left the restaurant owner with the responsibility of preventing diners from lighting a cigarette, which will cause very high fines, a situation that he considered unfair.

For this reason, he commented that the national CANIRAC has already opened the legal department for legal advice on the issue of protection, either in the coming days or at the time of the application of the law.

“In CANIRAC Nacional, the issue of giving legal advice for the amparo against fines is being discussed and, well, it is an issue that is now being analyzed, in order to carry out a formal action,” he said.

However, he indicated that this will already be a particular decision for each restaurant, because it is about complying with the law, but not assuming responsibilities that do not correspond to them.

He announced that in the next few days he will talk with the Coepris delegate in Sinaloa, with whom a meeting has already been scheduled to clarify doubts, so that the members can make their best decision.

What comes with the Anti-Tobacco Law

But, what does the new General Law for Tobacco Control imply with the corresponding regulation?

In the first instance, the provision of any food, beverage, or entertainment service, as well as its consumption, is prohibited, even within designated smoking areas.

Anyone who fails to comply with these provisions may receive serious economic sanctions, the temporary, partial, or total closure of their establishments and even arrest for up to 36 hours.
