Mazatlan City Council vs Mayor Could End in a Court of Justice

The actions of each of the parties have suggested that a battle of egos is being waged internally that could even end in the nullification of the charges of whoever is the ruling against.

Mazatlán, Sinaloa. -In a case cataloged by José Antonio Serna Valdez, delegate in Sinaloa of the Confederation of Colleges and Associations of Lawyers of Mexico, as a war of egos, he considered that it could even reach a Court of Justice, in order to solve the problem, However, he insisted that agreement and teamwork are the key objectives.

On the afternoon of yesterday, November 3, the body of councilors that make up the Mazatlán Cabildo declared Extraordinary Session number 2 to be held, in which they appointed the officials who will occupy the positions of Secretary of the City Council, Senior Official, and Treasurer, all this with the absence of the Mayor, Luis Guillermo Benítez Torres. Because of this, Serna Valdés pointed out that neither the mayor can “assume the functions of the councilors, nor can the councilors replace or exceed the powers that correspond to the president.”

“It is an unprecedented case what is happening in the City Council, the Municipal Government Law and the Internal Government Regulations, as some call it, because it indicates very clearly what are the powers of the president and what are the powers of the members of the city council , in this case the councilors and also indicates that neither the president can assume the functions of the councilors nor the councilors can replace or exceed the powers that correspond to the president ”, stated the lawyer.

According to the course that the case has taken in the last week, Serna Valdés considered that a court could even be reached to resolve the problem, however, the actions of each of the parties have suggested that internally, in the City Council, a battle of egos is being waged that could even end in the nullification of charges of whoever is the ruling against.

“Obviously everything indicates that it is going for a litigation, whether administrative or electoral and it may even have some responsibility as well, if it is not a behavior or incurring in some fault as public officials,” he stated.

“A consequence is the nullity of the acts if they go mainly by the Law of Administrative Responsibility, because it will be seen in due course the authority that it has to prevent political rights or things like that, and the authority will be the one who decides, I would not like anticipating such a situation, it is not my competence (…) now it is true that both an Administrative Court of Justice or an electoral authority could fail in this regard ”, he concluded.
