Only 12 states have classified attacks against the LGBTTTIQ + population as a hate crime.
For hate crimes to merit informal preventive detention, the Moreno deputy, Salma Luévano Luna (Morena), presented an initiative that reforms articles 303 of the Federal Criminal Code and 167 of the National Code of Criminal Procedures.
They will be hate homicides when the person who commits it is due to: social or economic condition; affiliation, membership or relationship with a defined social group; ethnic or social origin; nationality or place of origin; color or any other genetic characteristics; sex; tongue; gender; religion; age; opinions; disability; healthy conditions; physical appearance; sexual orientation; gender identity; gender expression; civil status; occupation or activity of the victim.
The document, sent to the United Justice and Diversity commissions, indicates that the purpose is to place in both codes the hate crime in relation to the lesbian, gay, bisexual, transvestite, transgender, transsexual, intersex, LGBTTTIQ + community.
Luévano Luna specifies that only 12 states have criminalized attacks or homicides against the population of sexual diversity. The entities that include criminal offenses that aggravate the penalties for these crimes are: Mexico City, Baja California Sur, Colima, Coahuila, Guerrero, Michoacán, Nayarit, Puebla, Querétaro, San Luis Potosí, Veracruz and Aguascalientes.
Surveys by the National Council to Prevent Discrimination (Conapred) place LGBT people in the first places among the populations with the highest levels of discrimination in the country and reveal that they live immersed in a context of discrimination and intolerance. Hate crimes or crimes due to sexual orientation and gender identity constitute and represent the expression of intolerance and rejection of diversity.
