Recommends residents to hire attorneys or accept payment with discounted fines and surcharges

Mazatlán, Sinaloa.- Neighbors of the Mediterráneo Club Residencial private subdivision criticized the position of the administration of that development since instead of defending them against excessive charges from Jumapam for the use of common water, they recommend hiring lawyers or accepting payment, with discounts on fines and surcharges.

In an internal statement, the person in charge of the administration, Rosa María Martínez, suggested three options before the pressure exerted by the Potable Water and Sewerage Board of Mazatlán, to collect a prorated amount of consumption of common water that does not detail and that considers tax credits declared null.

It is clarified that the Administration does not have the resources to cover the expenses in the payment of lawyers, so it will only be the link between the lawyers and the inhabitants to send documents and initiate the defense.

The first option is to accept the services of the “ Estudio Jurídico ” office, which has previously given legal advice to the condominium, to act in its defense, but which would have a cost of 2,500 pesos per person, which must be delivered before next Thursday. September 9, which ensures there would be a good chance of a favorable ruling that implies the nullity of the proration charge for the period from December 2017 to July 2021.

However, it is clarified that the time for the resolution of the claim is indeterminate because it depends on the work of the court and the defense of the parties, which could last between 6 and 12 months, during which time the Court will not be required to retaliation by Jumapam.

The second option is to hire the services of a lawyer who lives in the residential condominium and who knows the problem in detail, who would charge 2,100 pesos per person for her services.

In both options, it is requested that the documentation be delivered to the administration of the condominium to keep track of the people protected.

The third option is to accept the verbal commitment made by Mayor Luis Guillermo Benítez Torres to agree on the charge made to them in water bills and reduce the prorated amount of this consumption by about 50%, which is around 21 thousand 100 pesos.

In case they accept this proposal, it is suggested to go to the commercial management of Jumapam, to request information in this regard.

From the beginning, several neighbors have stated that this charge is illegal and arbitrary since they have always paid their home water bill in a timely manner, as well as the maintenance fee to the administration of the condominium, with which it must be covered the use of common water.

They say that if there is a millionaire debt for the use of water common to Jumapam, it is the developer or the builder, or the HOA administration who must cover the payment and not the residents.
