Mexico Supreme Court (SCJN) granted a six-month extension to regulate marijuana in Mexico

The Supreme Court of Justice of the Nation (SCJN) granted a six-month extension to the Senate so that it can exhaust the legislative procedure corresponding to the comprehensive regulation of marijuana.

Through an office, to which Milenio had access, the ministers deferred the term, “which expires on the last day of the regular session of the Congress of the Union, which will run from February 1 to April 30, 2020, within order that, at the end of said period, they have approved the corresponding legislation ”.

The document signed by Rafael Coello, General Secretary of Agreements of the SCJN, requests to notify both the Senate and the Chamber of Deputies of said extension.

A few days ago the presidency of the Board of Directors of the Upper House requested the Court to extend it. The SCJN issued a declaration of unconstitutionality of various articles of the General Health Law, which it defined as violating the fundamental right to free personality development.

The Court established a jurisprudence and declared articles 235 last paragraph, 237, 245 section I, 247 last paragraph and 248 of the General Health Law unconstitutional because they were considered as violating the right to free development of personality; among which the sowing, cultivation, harvest, elaboration, preparation, conditioning possession, commerce, transportation in any form, medical prescription, supply, employment, use, and consumption are prohibited.

For this reason, it instructed the Congress of the Union to modify or repeal these provisions, establishing a period from February 20 to October 31, 2019.

Therefore, the Senate Justice Commission, as coordinator of the work to generate comprehensive cannabis regulation, asked the presidency to request such extension to the constitutional term, in order to exhaust the legislative procedure.

Senators consulted by Milenio admitted that there is still no consensus to carry out the law and even the coordinator of Morena, Ricardo Monreal, said that there are many interests on this issue. “The amount of lobbyists around here is impressive,” he said.

Without specifying, he commented that there are many “legitimate” pressures of those who want to do “legitimate business”.

THE PREDICAMENT According to the forecast, the government plans to boost marijuana production with resources from private and development banks to bring peace to those areas hit by drug trafficking.

Advice, facilities and necessary accompaniments will be given to farmers, indigenous people and community members, as well as micro and small farmers, who will have priority in granting concessions.

The Senate circulated the prediction of the Cannabis Regulation Law and its discussion is expected to begin next Tuesday at the United Health and Justice Commissions, although it can be approved before the end of the month.

According to the document, it is expected to promote support and credits for production in Mexico, by establishing that these groups “will have preference over others less or less vulnerable in the granting of licenses and authorizations, it is sufficient that they accredit their quality or character and are legally constituted according to the legislation that governs them ”.

Stresses that the Mexican Cannabis Institute will have within its powers to implement affirmative measures in the granting of licenses, in order to ensure the incorporation into the lawful market of people and communities that have been disproportionately affected by the ban.

The prediction states that as a measure of social justice that seeks to compensate for the damages generated by the prohibition, for a period not less than five years after the decree enters into force, at least 20 percent of the cultivation licenses must be granted preferably to peasants or ejidos in the municipalities where during the period in which cannabis was prohibited, federal, state and municipal governments have carried out eradication of their plantations.

The Secretariat of Security and Citizen Protection will collect the information and propose to the Governing Board of the Mexican Institute of Cannabis the list of municipalities, mayors and referred communities.
