Judge frees Ex-Governor of Veracruz after stealing billions

A federal judge granted a suspension of sentence and ex officio to the former governor of Veracruz, Javier Duarte de Ochoa, which prevents the execution of the nine-year sentence for crimes of use of resources of illicit origin and organized crime, as well as the insurance of 40 properties.

The suspension was granted by the Administrative District Judge of the Criminal Justice Center in Mexico City, based in the North Prison, according to official letter 10137/2019, after Duarte challenged the criminal case 97/206.

“The officiating judge orders the suspension of office and plan of the claimed resolution. In such virtue, the suspension of any act tending to execute the sentence pronounced on September 26, 2018 is ordered, ”said the ruling, issued on Monday morning by Judge Marco Antonio Tapia Fuerte.

This resolution does not imply the freedom of the former governor of Veracruz until a Collegiate Court is pronounced, that is, while the Amparo promoted is resolved.

This is the second time in the year that one of Duarte’s files needs the attraction of a court, to determine the legal status of the Veracruz ex-governor.

On May 23 ( Process 2229), the Fourth Collegiate Court in Criminal Matters of Mexico City determined to attract an Amparo that was promoted against the arrest warrant for the crime of “forced disappearance” requested by the Attorney General’s Office (FGJ) of Veracruz Justice.

Duarte was sentenced for the crimes of use of resources of illicit origin and organized crime after he pleaded guilty to the same judge: Tapia Fuerte. Given this, he filed an Amparo against the sentence issued in criminal case 97/206 whose effects will have to be resolved by a magistrate.

Duarte has insisted in recent weeks on his innocence; He even recently leaked a video, allegedly taken hours before his arrest, in which he says it would be delivered to the Guatemalan and Mexican authorities of their own accord.
