Our CONDO NIGHTMARE in Puerto Vallarta, Mexico told in pictures and words.

Last year we were swindled by developer/builder, Jose Francisco Sanchez Ramirez (Joe Sanchez) and we were failed by our realtor Warren Brander.

HERE’S WHAT HAPPENED TO US IN A NUTSHELL…

we signed a purchase agreement to buy a condo from Joe Sanchez.
we took possession of the condo and lived there 6 weeks
he locked us out of our home
he has our money and our possessions now for over 425 days and counting

Instead of retiring to a city of joy and light after a lifetime of work, our lives are full of attorneys, stress and financial damages.

We want to convey how traumatic and emotionally devastating this has been and continues to be for us.

Joe Sanchez has all the above and our money.

We have no idea what Joe Sanchez has done with our things. What has been done to us is unconscionable.

  • accepted a pre-payment of 80% of the entire purchase price
  • accepted an additional $21,748.21 for upgrades

  • Joe Sanchez cut off our electricity and water
  • locked us out of our home

The Summit Eco Townhomes & Sky Terrace has issued the following Statement from Max Living and Design


We invite you to read David and Michael’s document in an objective manner. You will see the inconsistencies are glaring and their statements are riddled with impossibilities. How, if as they claim, I repeatedly did not show up to court, am I not in jail? What benefit would we have in keeping their belongings? Their story simply does not add up. It is not only my reputation but that of Warren Brander, a well-respected professional with hundreds of successful closings under his belt, as well as Tropicassa, one of the most established real estate firms in town, who were my agents. 
David Troy Francis and Michael Boustead are the makers of their own nightmare and now, with their false allegations and vengeful actions, ours as well. They have lied, bribed, threatened and done everything possible to damage my reputation and my family in extraordinarily unethical ways. 
They did not want to continue with the contract and made attempts to force me into a different agreement requiring money and work given to them without merit. They have carried out illicit illegal acts against me, in the violation of my rights. They have attempted to extort 450k usd from my company in an act that, even their own attorney, said had no legal basis. Their legal war against me is proving to be fruitless and they are lashing out against all involved. This defamation is a last ditch effort to cause me harm when they were the ones responsible for this unfortunate result. 
We have been living in Puerto Vallarta for 11 years with our two young children, my elderly parents (my father has advanced Alzheimier’s), my siblings and many friends. Being part of a small, tight-nit community has been great after living in Chicago for many years. We understand, both personally and professionally, that reputation is paramount in Puerto Vallarta. We would not risk our reputation because we understand and value its importance. 
The defamatory blog that David and Michael have written is a hurtful and damaging lie which does not accurately address the series of events that took place over the last year. 
From the start, we did everything possible to accommodate David and Michael. As with construction anywhere in the world, things do not always go as planned. Timing is not 100% accurate. There was no contractual penalty for delayed delivery. However, in effort to accommodate David and Michael, I offered Nemi Eco Villa as a residence free of charge while finishing touches were being made to the unit. 
When they decided Nemi, a 1200usd a night villa, was not comfortable enough, I offered to include work credit to offset the cost of a rental. When their piano and other belongings arrived, I, in good faith, allowed them to move them into the unit though closing had not yet happened. I paid for a crane that hoisted their grand piano through the window knowing that it would not fit once the unit was completed. I was, as am with all my clients, 100% available to them. I understood their inconvenience of not having their unit on time and made every effort to accommodate them. Time and time again, they looked for ways to take advantage of my efforts. 
This town is where we live, where our family and friends live. We are not a fly-by-night operation. We have many satisfied and happy clients who would vouch for our craftsmanship and integrity. The only reason David and Michael don’t have a unit is because they failed to honor their contract. The only reason they do not have their belongings is because they failed to come and collect them. And the only reason they do not have a full refund is because they refuse to take it. 
I am proud of my team. I am proud to contribute to this city by employing hard working honest people. I believe that I am also contributing to the conversation about sustainability and low-density development in an overbuilt city.
